2. SCHEDULE: Sweepstakes begins on or around February 11, 2008 and ends June 20, 2008.
3. TO ENTER: To enter the Sweepstakes, simply visit our web page at https://www.StradaHerbicide.com and complete the online entry. Alternately you may fill out and return the Sweepstakes Entry Card Questionnaire, or on a 3" X 5" post card legibly print your full name, age, street address, city, state, zip code, day and evening telephone numbers with area code, number of rice acres and whether you are a rice consultant or a grower. Mail to: Strada Gift Card Sweepstakes P.O. Box 83672, Stillwater, MN 55083-0672. One entry per person, please. All entries must be received by June 20, 2008. Copies and mechanically reproduced entries will not be accepted. Sponsor is not responsible for incomplete, lost, late, damaged, illegible, or misdirected email or for any technical problems, malfunctions of any telephone lines, computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled, or delayed computer transmission or any combination thereof. Sponsor not liable for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion. Any use of robotic, automatic, programmed or the like methods of participation will void all such submissions by such methods. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process. In the event of a dispute regarding any entry, the entry will be deemed made by the authorized account holder of the email address submitted at the time of entry (i.e., the person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address). Sponsor reserves the right, in its sole discretion, to cancel or suspend this sweepstakes should a virus, bugs, or other causes beyond the control of the Sponsor corrupt the administration, security, or proper operation of the sweepstakes. In the event of termination of the sweepstakes, a notice will be posted online and a random drawing to award the prizes will be conducted from among all eligible entries received prior to the time of termination. Sponsor reserves the right to modify the sweepstakes or disqualify entrant if fraud, misconduct, or technical failures destroy the integrity of the sweepstakes as determined by Sponsor, in its sole discretion. All material submitted becomes the sole property of Sponsor and will not be returned. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the sweepstakes, or in the announcement of the prizes. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet Service Provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail.
4. DRAWING: Winner will be selected in a random drawing from all eligible entries received. Drawing will be conducted by an independent judging organization on or around June 30th, 2008. Judges' decisions will be final and binding in all matters relating to this sweepstakes. By entering the Sweepstakes, entrants agree to be bound by these rules and the decision of the judges.
5. PRIZES: Prizes will be awarded from all eligible entries received. FIVE (5) $100.00 Bass Pro ShopsTM Gift Certificates. Total value of prizes $500.00. Prizes are not exchangeable or transferable and may not be directly exchanged for cash. Odds of winning depend on the number of eligible entries received.
6. ELIGIBILITY: Participation in the Sweepstakes is open only to legal U.S. residents age 18 or older that are actively involved in rice growing or rice crop consulting. Void where taxed, restricted or prohibited by law and in NY, FL, and RI. The following categories of persons are not eligible to participate or win: persons who from and after January 1, 2008 were or are employees of Isagro USA or its subsidiaries or affiliated companies, individuals engaged in the development, production or distribution of materials or the implementation of this sweepstakes, and persons in the immediate family or living in the same household of any person in any of the above mentioned categories.
7. CONDITIONS: Provisional prize winners will be notified via USPS or UPS and must sign and return an Affidavit of Eligibility and Release within 10 days of notification in the prepaid return envelope supplied. In the event of non-compliance, or if the prize notification is returned as unclaimed or undeliverable, the prize will be forfeited and awarded to an alternate winner. All federal, state and local laws apply. All federal, state and local taxes on prize and all other expenses not specifically set forth herein are the sole responsibility of the winner(s). Entry and acceptance of prize constitutes permission to use winner’s name, address (city and state), likeness, and any statements regarding the promotion for advertising and promotional purposes, without additional compensation except where prohibited by law. No transfer of prize, no prize substitution or cash equivalent for prize except at sponsors’ sole discretion. Entry forms submitted become the property of the sponsor and will not be returned. By participating, entrants agree to abide by these rules and release Isagro USA, its' subsidiaries, affiliates, agencies and employees from any and all liability, loss, damage, cost or expense whatsoever including without limitation property damage, personal injury and/or death which may arise directly or indirectly from acceptance or use of prize or traveling to any prize related activity. Sponsor is not responsible for the quality of merchandise purchased with winning gift card. Sponsor shall have the right to post the Winners’ names, places of residence, and pictures on one or more Isagro USA affiliated websites without additional compensation.
8. DISPUTE RESOLUTION. Each participant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with this promotion, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of North Carolina; (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this promotion, but in no event shall such damages include attorneys’ fees; and (c) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to punitive, incidental, or consequential damages, or any other damages other than actual out-of-pocket expenses. Participants shall not claim or receive any damages subject to being multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participants and the Sponsor in connection with the Giveaway, shall be governed by and construed in accordance with the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of North Carolina or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of North Carolina.
